1. Online Store Terms
By using this website, you represent that you are legally capable of entering into a binding agreement in your jurisdiction or that you have obtained any required consent to use the website.
You agree not to use our products, website, artwork, content, or services for any unlawful or unauthorized purpose or in violation of applicable laws.
We reserve the right to refuse service, cancel an order, limit quantities, or restrict access to our website when reasonably necessary to prevent fraud, misuse, unlawful activity, abuse, or violations of these Terms.
2. Products, Artwork, and Historical Collectibles
Aces In Action offers products that may include original artwork, reproductions of artwork by Craig Tinder, limited-edition artwork, artwork incorporating authentic historical relics, historical artifacts, collectible displays, paper prints, apparel, merchandise, digital products, commissioned artwork, and other products.
We make reasonable efforts to accurately display and describe our products. However, colors and appearance may vary depending on photography, lighting, computer monitors, mobile devices, manufacturing processes, materials, and other factors.
Dimensions and measurements are approximate unless expressly stated otherwise.
Product availability, edition availability, materials, specifications, packaging, and pricing may change without notice.
3. Authentic Historical Relics and Artifacts
Certain Aces In Action products incorporate or include authentic historical relics or artifacts.
Historical materials naturally vary. Relics from the same source may differ in color, markings, surface condition, oxidation, wear, texture, shape, or other characteristics. These variations are inherent to genuine historical material and are not considered manufacturing defects.
Historical artifacts may also exhibit wear, discoloration, corrosion, markings, repairs, damage, weathering, or other evidence of age and prior use.
Aces In Action makes reasonable efforts to research and document the provenance and historical context of relics and artifacts based on available records, documentation, source information, physical evidence, and other relevant information. Historical research can contain uncertainty, and new information may become available over time.
Unless specifically stated otherwise, historical artifacts and relics are sold as collectibles, artwork components, display pieces, or historical objects and are not represented as suitable for operational use.
4. Limited Editions
Certain artwork is offered in limited editions.
Edition availability is subject to inventory and may vary by size, format, material, or other configuration. Once a limited edition or particular format has sold out, Aces In Action is not obligated to reproduce or restock it.
Where applicable, edition numbers, artist signatures, certificates, relics, and other identifying components form part of the collectible nature of the product.
Purchase of a physical artwork or print does not transfer copyright, reproduction rights, licensing rights, or other intellectual-property rights in the underlying artwork.
5. Orders and Order Acceptance
Submitting an order does not necessarily constitute final acceptance of the order by Aces In Action.
We reserve the right to decline or cancel an order when reasonably necessary, including because of:
- Product or inventory availability
- Pricing or listing errors
- Suspected fraud or unauthorized transactions
- Shipping restrictions
- Errors in customer or payment information
- Legal or regulatory restrictions
- Circumstances that make fulfillment impractical or impossible
If we cancel an order after payment has been collected and no product has been provided, we will issue an appropriate refund.
We may limit quantities purchased by an individual, household, account, payment method, or order when reasonably necessary.
6. Pricing and Product Information
We make reasonable efforts to ensure that pricing, product descriptions, photographs, specifications, and availability information are accurate.
Occasionally, information may contain typographical errors, inaccuracies, or omissions.
If a material pricing or listing error affects an order, we may contact you before fulfillment to provide the option of proceeding under the corrected terms or cancelling the affected item or order for a refund.
Prices and promotions may change without notice. Discounts, promotional codes, and special offers may be subject to additional restrictions and may not be combined unless specifically stated.
7. Made-to-Order and Print-on-Demand Products
Certain products are manufactured or printed specifically after an order is placed. These may include paper prints, apparel, mugs, desk mats, artwork, and other merchandise.
Made-to-order products may enter production shortly after purchase.
Customers are responsible for reviewing product descriptions, dimensions, sizes, colors, quantities, and other selections before submitting an order.
Made-to-order and print-on-demand products are subject to our Return & Refund Policy.
8. Custom and Commissioned Artwork
Custom and commissioned artwork may be subject to additional terms, pricing, deposits, approval processes, production schedules, and specifications communicated at the time of commission.
Unless otherwise agreed in writing, commissioning artwork does not transfer copyright or reproduction rights in the artwork to the customer.
Aces In Action and Craig Tinder retain applicable intellectual-property rights in commissioned artwork except to the extent expressly transferred through a separate written agreement.
9. Returns, Refunds, and Cancellations
Returns, refunds, exchanges, damaged products, and order cancellations are governed by our Return & Refund Policy, which is incorporated into these Terms by reference.
Many Aces In Action products are limited-edition, contain authentic historical relics, are custom-produced, or are manufactured specifically for an individual order. As explained in our Return & Refund Policy, many products are therefore considered final sale.
Nothing in these Terms or our Return & Refund Policy limits rights that cannot legally be excluded under applicable consumer-protection law.
10. Shipping and Delivery
Customers are responsible for providing complete and accurate shipping information.
Shipping and delivery dates are estimates unless expressly guaranteed in writing. Delays may occur because of carriers, weather, customs, production schedules, supply availability, holidays, or circumstances outside our reasonable control.
Risk associated with lost, damaged, or misdelivered shipments will be handled in accordance with our applicable shipping and Return & Refund policies and any rights provided by law.
International customers are responsible for complying with applicable import requirements. Customs duties, taxes, brokerage fees, or other charges imposed by the destination country may be the customer's responsibility unless otherwise stated at checkout.
Certain historical artifacts or other products may be subject to domestic or international shipping, import, export, carrier, or legal restrictions. We reserve the right to decline or cancel an order when shipment would violate applicable restrictions or when we cannot reasonably complete delivery.
11. Intellectual Property
The artwork and illustrations created by Craig Tinder are protected by applicable copyright and intellectual-property laws.
Except where expressly authorized in writing, purchasing an original artwork, print, relic artwork, collectible, digital product, or other product does not grant the purchaser any right to reproduce, publish, distribute, modify, license, manufacture from, commercially exploit, or create derivative commercial products from the underlying artwork.
Content created or owned by Aces In Action or Craig Tinder—including artwork, illustrations, photographs, graphics, logos, product designs, written content, videos, and other original materials—may not be reproduced, distributed, published, sold, commercially exploited, or used to create competing products without applicable authorization.
Certain names, logos, insignia, trademarks, historical photographs, archival materials, or other third-party content displayed on our website may belong to their respective owners. Nothing in these Terms claims ownership by Aces In Action of intellectual property belonging to third parties.
Products identified as officially licensed are offered pursuant to the applicable licensing arrangements. Third-party trademarks and intellectual property remain the property of their respective owners.
12. Historical and Educational Context
Aces In Action creates and sells artwork, collectibles, artifacts, and educational materials relating to military, aviation, maritime, space, transportation, and other historical subjects.
The depiction, discussion, sale, collection, or display of historical persons, governments, military organizations, symbols, equipment, uniforms, vehicles, or events is for historical, artistic, educational, documentary, or collecting purposes.
Such depiction or discussion does not constitute endorsement by Aces In Action or Craig Tinder of the political ideology, actions, policies, beliefs, organizations, or governments associated with those historical subjects.
13. Customer Reviews and Submitted Content
If you voluntarily submit a review, photograph, testimonial, comment, or other content to Aces In Action, you retain ownership of content that you own.
By submitting such content for publication or promotional use, you grant Aces In Action a non-exclusive, worldwide, royalty-free license to reproduce, display, publish, and use that content in connection with our website, products, marketing, advertising, social media, and business operations, subject to applicable law.
You represent that you have the right to provide content you submit and that its use will not infringe the rights of another person.
We reserve the right to decline, moderate, or remove submitted content that is unlawful, fraudulent, abusive, defamatory, misleading, infringing, inappropriate, or unrelated to the purpose for which it was submitted.
